Depending on how you use InkPanel, we may process information including:

  • dispute and chargeback information; and
  • information you choose to provide through platform functionality.

InkPanel does not need to receive full payment-card details where those details are collected directly by the payment provider.

  • connect Customers and Studios;
  • send transactional notifications;
  • provide customer support;
  • operate subscriptions;

  • improve InkPanel;
  • comply with legal obligations;
  • enforce our Terms; and
  • send or facilitate marketing where legally permitted.

4. Lawful Bases

Depending on the processing activity, we may rely on:

Contract — where processing is necessary to provide services you request or take steps before entering a contract.

Legal obligation — where we must process information to comply with law.

Legitimate interests — where reasonably necessary for legitimate business purposes such as platform security, fraud prevention, service improvement and managing disputes, provided those interests are not overridden by your rights.

Consent — where consent is appropriate or required, including certain electronic-marketing activities or sensitive-data processing.

Other lawful bases may apply where permitted by law.

5. Studios

When a Customer makes a booking or transaction, relevant information is shared with the Studio so that the Studio can administer and provide the Studio Service.

Studios are independent businesses and may act as separate data controllers for information they receive and use for their own purposes.

Customers should also review the relevant Studio's privacy information where available.

6. Payment Providers

InkPanel uses third-party payment providers, including Stripe, to process and facilitate payments.

Information necessary to process payments, prevent fraud, manage payouts and handle disputes may be shared with the payment provider.

Payment providers process information under their own applicable privacy terms where they act independently.

7. Service Providers

We may use suppliers to provide services such as:

  • hosting;
  • infrastructure;
  • communications;
  • SMS delivery;
  • email delivery;
  • analytics;
  • customer support;
  • security;
  • payment processing; and
  • professional services.

We require providers handling personal information on our behalf to protect that information appropriately.

8. Marketing

InkPanel may send marketing communications where legally permitted.

Where consent is required, marketing will only be sent on the basis of valid consent or another lawful permission available under applicable electronic-marketing law.

You may opt out of InkPanel marketing at any time using the unsubscribe mechanism provided or by contacting us.

Transactional messages concerning bookings, payments, account security or service administration are not necessarily marketing messages.

9. Studio Marketing Through InkPanel

Studios may use InkPanel functionality to send or automate communications.

Depending on the circumstances, the Studio may determine the purpose of that communication and be responsible for ensuring it has the necessary permission to send it.

InkPanel may process contact information on the Studio's instructions to provide messaging functionality.

10. SMS

Telephone numbers may be used for transactional SMS messages concerning bookings and related services.

Marketing SMS messages will be handled in accordance with applicable electronic-marketing requirements.

Recipients must be provided with appropriate ways to stop marketing communications.

InkPanel may in future enable Studios to use digital consultation and consent forms.

Those forms may potentially contain information concerning health, allergies, medications or other sensitive matters.

This functionality may not currently be available.

Before enabling processing of special-category information through such functionality, InkPanel will implement appropriate legal, technical and organisational safeguards and determine the applicable lawful basis and special-category processing condition.

Studios using such functionality will also be responsible for ensuring that the information they request is lawful, necessary and appropriate.

12. Special-Category Information

Where InkPanel processes special-category personal data, such as health information, we will only do so where an applicable lawful basis and additional special-category condition exist.

We will apply additional safeguards where appropriate.

Special-category information will not be used for unrelated marketing merely because it is available through the platform.

13. Payment Disputes

Where a transaction is disputed, InkPanel may use and disclose relevant information to the Studio, Stripe, banks, card networks, professional advisers and other parties reasonably necessary to investigate, defend or resolve the dispute.

This may include booking details, acceptance records and relevant communications.

14. Fraud and Security

We may process information to identify suspicious activity, protect accounts and prevent fraud.

We may retain security records where reasonably necessary to protect InkPanel and its users.

15. Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected and to satisfy legal, accounting, tax, fraud-prevention and dispute-management requirements.

Different categories of information may have different retention periods.

Information associated with financial transactions or legal disputes may be retained longer than ordinary account information where reasonably necessary.

16. International Transfers

Some service providers may process information outside the United Kingdom.

Where UK data-protection law requires safeguards for an international transfer, we will use an approved transfer mechanism or another lawful basis for that transfer.

InkPanel is not intended to enable children to independently enter transactions that they cannot lawfully enter.

We may update this Privacy Policy as InkPanel develops or legal requirements change.

The current version will be published through InkPanel with its last-updated date.
